Abstract

      Praise be to Allah، Praise be to God, with whose grace good deeds are accomplished, and prayers and peace be upon our Master Muhammad, the Seal of the Prophets and Messengers, and upon his family and companions all:

This research aims to identify the judge with tenderness, and to explain the rulings of harshness regarding those who deliberately broke their fast.

 The approach followed in the research is attributing the Qur’anic verses contained to their surahs, and grading the hadiths of the Prophet contained in the manuscript. What was mentioned in the two Sahihs was sufficient for his grading, and what was outside of them was added to that the ruling of the hadith, relying on the specialists in that, and documenting the quotations and narrations from their places, and this was mentioned in footnote.

Where the research was limited to two topics, the first topic is the definition of Al-Qadi Bahnan and his book “Nail Al-Maqsud” and the second topic is an investigation (Chapter: Intensification of what he deliberately broke the fast from the book “Fasting” from the book “Nail Al-Maqsud”.

The research came to highlight Muslim scholars in general and Yemeni scholars in particular, and to introduce them and their scientific effort in serving the Sunnah of the Prophet, as well as highlighting the opinions of scholars in the rulings on the harshness of those who intentionally broke their fast.

The research reached results, the most important of which are:

- Al-Qadi Bahnan’s interest in his book “Neil Al-Maqsoud” and its publication in a wonderful qashiba suit, befitting the science it contains.

This book is filled with various jurisprudential issues and various benefits, including: mentioning the hadith followed by a translation of the men of the chain of transmission, attributing the hadith to its context, mentioning the words included in the narration followed by attribution, judging the hadith, exposing the words mentioned from the linguistic point of view, and explaining the meanings of strange words. And he listed the opinions of the jurists on the issues mentioned in the hadith, as it is more like a scholarly encyclopedia of jurisprudential hadiths.

The research concluded with a set of recommendations and proposals, as it is edited in the conclusion.
